Terms of Use
Last updated: March 2025
Please read these Terms of Use carefully before accessing or using the MotionLab platform. By creating an account or using any part of the service, you agree to be bound by these terms. If you do not agree, you must not use MotionLab.
1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and MotionLab ("MotionLab", "we", "us", or "our") governing your access to and use of the MotionLab website, mobile application, and any related services (collectively, the "Service"). By accessing the Service in any way — including browsing, registering, or completing a session — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Service
MotionLab is a guided stretching and mobility platform designed to help users improve their range of motion and movement quality through personalised exercise routines. The Service includes a mobility assessment tool, algorithmically generated stretching sessions, exercise libraries with instructional content, session history and progress tracking, and related features. MotionLab is intended for general wellness and fitness purposes only. The Service is not a medical device, and nothing within it constitutes medical advice, diagnosis, or treatment. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
3. Account Registration
To access certain features of the Service, you must register for an account. By registering, you represent and warrant that:
- You are at least 16 years of age. Users under 16 may not create an account or use the Service.
- All information you provide during registration is accurate, current, and complete, and you will keep it up to date.
- You will maintain the confidentiality of your account credentials and are solely responsible for all activity that occurs under your account.
- You will notify us immediately at legal@motion-lab.io if you suspect any unauthorised access to or use of your account.
- You will not create an account using a false identity or on behalf of someone else without their express permission.
We reserve the right to refuse registration or cancel accounts at our discretion, particularly where we believe these Terms have been or may be violated.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. The following conduct is expressly prohibited:
- Using the Service for any illegal purpose or in violation of any applicable law or regulation.
- Scraping, crawling, or systematically downloading content from the Service without our prior written consent.
- Reverse engineering, decompiling, disassembling, or attempting to derive the source code of any part of the Service.
- Reselling, sublicensing, or otherwise commercialising access to the Service or its content without our express written permission.
- Uploading or transmitting viruses, malware, or any code designed to interrupt, destroy, or limit the functionality of the Service or its underlying infrastructure.
- Attempting to gain unauthorised access to any part of the Service, its servers, or any database or system connected to the Service.
- Harassing, threatening, or harming other users or MotionLab staff through the Service.
- Circumventing any access controls, subscription limitations, or security measures in place on the Service.
5. Health & Fitness Disclaimer
MotionLab provides general fitness and wellness content for informational and educational purposes only. The exercise routines, instructions, mobility assessments, and any other content provided through the Service do not constitute medical advice, diagnosis, or treatment, and should not be treated as such.
Before beginning any new exercise programme — including the routines provided by MotionLab — you should consult with a qualified healthcare professional, particularly if you have any pre-existing medical conditions, injuries, chronic pain, cardiovascular issues, are pregnant, or have recently undergone surgery. By using the Service, you acknowledge that:
- Physical exercise carries inherent risks, and you assume full responsibility for your participation.
- You will stop any exercise immediately if you experience pain, dizziness, shortness of breath, or any other concerning symptom, and seek medical advice before resuming.
- MotionLab content uses language such as "may help improve mobility" and "supports better movement" intentionally — we do not guarantee specific health outcomes.
- You are responsible for listening to your body and exercising within your own limits and capabilities.
6. Intellectual Property
All content made available through the Service — including but not limited to exercise descriptions, instructional text, images, video content, audio, software, algorithms, interface design, logos, trademarks, and the MotionLab brand — is owned by or licensed to MotionLab and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any part of the Service content without our prior written consent.
You retain ownership of any personal data you provide to MotionLab, including your session history, mobility scores, and preferences. You grant MotionLab a limited, non-exclusive licence to process and use that data for the purposes described in our Privacy Policy, including to deliver and improve the Service.
7. User Content
When you use the Service, certain data is generated and stored, including your session completions, exercise preferences, mobility assessment results, goals, and onboarding responses ("User Data"). By using the Service, you grant MotionLab a worldwide, non-exclusive, royalty-free licence to store, process, and analyse your User Data for the following purposes:
- Delivering the core functionality of the Service, including generating personalised routines.
- Improving and developing MotionLab's features, algorithms, and content.
- Providing you with account-related communications and support.
We do not sell your personal data to third parties. Any use of your data is governed by our Privacy Policy. You may request deletion of your account and associated data at any time as described therein.
8. Privacy
Your privacy is important to us. Our collection, use, and storage of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in that policy. Please read it carefully to understand how we handle your information.
9. Limitation of Liability
To the fullest extent permitted by applicable law, MotionLab and its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of, or inability to use, the Service or any content thereon, regardless of the legal theory under which such damages are claimed, and even if MotionLab has been advised of the possibility of such damages.
In no event shall MotionLab's total aggregate liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you have paid to MotionLab in the twelve months preceding the claim, or (b) CAD $50 / €50 / $50 USD. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
10. Disclaimers of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MOTIONLAB EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any content provided through the Service.
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or if required to do so by law. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through the account settings or by contacting us at legal@motion-lab.io. Termination does not relieve you of any obligations incurred prior to the date of termination, and provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall continue to apply.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Canada. If you access the Service from a jurisdiction outside Canada, you do so at your own initiative and are responsible for compliance with your local laws to the extent applicable.
13. Changes to Terms
We may revise these Terms from time to time at our discretion. Material changes will be communicated to registered users via email or in-app notification at least 14 days before they take effect. Minor or administrative changes may be made without specific notice. The "Last updated" date at the top of this page will always reflect the most recent revision. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
